Abstract
This eviction-related notice, dated September 2, 1967, demands that Peter S. Berg pay back rent for August and September on the premises at 901 Cole Street or surrender possession. As a Digger-related document, it gives a stark glimpse of the material conditions surrounding the Trip Without A Ticket free store: even a space dedicated to Free existed within the ordinary legal machinery of rent, ownership, and eviction. Its importance lies in that tension between the Digger practice of Free and the property system pressing in around it.

NOTICE TO PAY RENT OR SURRENDER POSSESSION

TO MR. PETER S. BERG, tenant in possession:

You are hereby required to pay the rent of the premises leased to you at 901 Cole Street, San Francisco, California, for the month of August, 1967, amounting to the sum of $250.00, within three (3) days after the service of this notice on you, or deliver up possession thereof, or I shall institute legal proceedings against you to recover possession of said premises.

You are further required to pay the rent of the premises leased to you at 901 Cole Street, San Francisco, California, for the month of September, 1967, amounting to the sum of $250.00, within three (3) days after the service of this notice on you, or deliver up possession thereof, or I shall institute legal proceedings against you to recover possession of said premises.

You are notified that the acceptance by me of the past due rental of $250.00 for the month of August, 1967, will be entirely without prejudice to my rights and causes of action in my action against you now pending in the Municipal Court of the City and County of San Francisco, State of California, numbered 589,222, nor will the acceptance by me of said rental constitute any waiver by me of any of said rights or causes of action.

You are further notified that the acceptance by me of the past due rental of $250.00 for the month of September, 1967, will be entirely without prejudice to my rights and causes of action in my action against you now pending in the Municipal Court of the City and County of San Francisco, State of California, numbered 589,222, nor will the acceptance by me of said rental constitute any waiver by me of any of said rights or causes of action.
